Suppression & Informant Issues

Criminal Defense Cases:

Suppression and Informant Issues

To provide strong defense against criminal charges, every aspect of a case must be thoroughly reviewed. One area that should be looked at closely is the information that led to your arrest, and the manner in which law enforcement obtained that evidence. The law provides specific guidelines as to how suspects are to be treated and how police may gather and collect evidence and information. The law gives you rights. As your attorney, I will make certain those rights were observed.

I have handled criminal matters since 1983. My experience has taught me to dig deep into a case to ensure that all of the facts are visible. I will go over your case to ensure your rights were not violated by an unconstitutional act or a tainted information source.

Informants

In drug cases, murder cases, and other major cases, the police often rely on tips from confidential informants to build a case against you. More often than not, these informants have their own interests in mind. Typically, they provide information in exchange for, or in hopes of, bettering their own situation. I believe this makes them inherently unreliable. I will review all issues related to the use of information from an informant for validity and legality, and challenge the reliability of an informant's tip.

Suppression

When police are in the process of gathering information, they have certain steps they are required to follow to ensure that your rights are protected. If these steps are not taken, any unlawfully obtained evidence can be suppressed so that it cannot be used by the prosecution at trial. I will examine any searches and seizures done by the police, police interrogations, and witness statements, to ensure that your rights were observed. If evidence was obtained illegally, we can file a motion to suppress that evidence so that it cannot be introduced in court. I believe in justice. I believe in leveling the playing field.
